Our Solution Seeking Principles

Stepping Away from an Adversarial Trajectory
The solution-seeking
mindset.
1. Stepping Away from an Adversarial Trajectory
For us to be able to help you, there naturally must be a dispute – which usually seeks or requires a solution. With most disputes at least one party wants a change in the status quo. In the litigious legal process, we call one Party the Plaintiff or Applicant, and the other the Defendant or Respondent, but this terminology immediately creates an adversarial environment wherein both parties are inclined to think that they only win when the other party loses, and this limits the scope of potential solutions to the dispute.
Disputesolve therefore uses a continuum of alternative dispute resolution mechanisms to allow parties, where possible, to focus resolving the dispute in an environment which requires and cultivates a mindset of cooperation and compassion.

Due Process
Diligently following due
process.
2. Due Process Diligently following due process.
Disputes of any nature, whether contractual, substantial, formal, informal, natural or juristic, require that due process be followed when such a dispute is being resolved. Due process cares less about where the dispute came from, but cares more that the basic rules of natural justice and process be adhered to as early as possible.
These include:
- Giving the other party adequate notice of the dispute or grievance;
- Giving the other party a fair and reasonable opportunity to be heard - to respond and to give their version of the dispute;
- Disallowing preconceived notions, prejudices and biases when attempting to resolve the dispute.
Those involved in a dispute are usually aggrieved, whether economically or emotionally – but the more you lay down proper and sincere foundations of process for the solving of your dispute, the easier it will be to successfully resolve the dispute. Disputesolve therefore uses personal and semi-automated mechanisms to initiate and adhere to due process principles.

Quality Assurance
Substantive and procedural fairness.
3. Quality Assurance Substantive and procedural fairness.
There are many types of disputes, each is on its own on the scale of severity; there are however many types of solutions – the most beneficial one being the one that is easy, affordable and working for all the parties to a dispute.
At Disputesolve we are acutely aware that not all disputes will actually be solved through alternative processes, but there are many that can be solved, or can benefit from, an alternative process aimed at an effective solution.
During these processes and solution seeking expeditions, we will always adhere to substantive and procedural principles of fairness – so even if the dispute is solved outside of the courtroom, correctness and integrity remain the hallmark of how we do our work.

4. Security and Privacy Adherence to statutory requirements.
Any process requires strict adherence to the rules regarding security, privacy and confidentiality. Any data or information obtained and shared is therefore safe and secure against any third parties. Alternative dispute resolution also ensures privacy, as the dispute is ultimately settled in the private sphere, and not in the public legal sphere. Confidentiality is also maintained throughout the entire process, and any disclosure of any kind should and must be the subject to an agreement to such an affect.
